Conditions Of Use and Limited Warranty
Use of this Med Legal Source/Medical Legal Counseling website, and the services of Eva Ettedgui, RN, CLNC, hereinafter jointly referred to as "MLS", is limited to law firms, attorneys and their paralegals, hereinafter "Client(s)". MLS will respond to Client(s) questions and/or requests for information by e-mail, telephone, facsimile, correspondence, or at in-person meetings, hereinafter referred to as "Responses".
MLS provides professional services as a Virtual Nurse, Medical Legal Consultant and Expert Witness Locator. These services are provided by a California licensed, certified and accredited Registered Nurse pursuant to The Nurse Practice Act of California under Business and Professions Code Chapter 6, California Code of Regulations, Titles 16 and 22, as may be amended, and a Certified Legal Nurse Consultant (CLNC) certified by The Vickie Milazzo Institute, National Alliance of Certified Legal Nurse Consultants, Houston, Texas. The professional services of MLS are nursing opinions based on professional training and research of the medical and nursing standards of care on the state and federal and community levels as appropriate for each individual case. The professional services rendered hereunder are not those of a California licensed medical doctor or physician.
All Responses by MLS are based solely on the information provided by Client(s). MLS is not responsible for Responses where Client(s) failed to disclose relevant medical information forming the subject of the inquiry which if disclosed may have changed the contents of the Response.
Responses by MLS are not intended as advice for medical treatment, diagnosis or care of a patient or medical illness.
MLS is not responsible for Responses unknowingly given to inquiries from Client(s) opposing counsel in the same dispute, whether it be in pre-litigation, litigation, mediation, arbitration, trial, or post litigation. Every effort will be made by MLS to avoid such conflicts.
All information passing to and from MLS and Client(s) shall be strictly confidential and MLS shall use its best efforts to protect that confidentiality.
Client(s) agree to indemnify and hold harmless MLS including its owners, officers, directors, partners, employees, agents and representatives, including Eva Ettedgui, RN, CLNC, against any and all costs, losses, or damages, including any incidental or consequential damages, expenses, lost profits, lost savings, or any other damage, including damages to Client(s) computer, programs including internet, or software, arising out of their use of this website, Client(s) disclosure of information to MLS that is attorney-client protected or in any other way confidential or proprietary, Responses unknowingly given to Client(s) opposing counsel, MLS's reasonable failure to maintain the confidentiality of any information passing to or from Client(s), the content of any Response by MLS, Client(s) use of MLS to give testimony whether or not as an expert witness, or for any physician or medical expert witness referral.
Any dispute between Client(s) and MLS arising out of related to the services of MLS shall be subject to mediation as a condition precedent to arbitration. Any dispute between Client(s) and MLS arising out of or related to the services of MLS not resolved in Mediation shall be determined by submission to arbitration as provided by law, and each party waives their right to a court of law before a jury or non-jury under the laws of the state of California which shall apply to all aspect of Client(s) use of the services of MLS. In any legal proceeding, including arbitration, the prevailing party shall be entitled to recover reasonable attorneys' fees and costs.
